Teacake Bake Shop 2008 Gingerbread House Contest Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. CONTEST IS OPEN ONLY TO ADULTS WHO REACH THE AGE OF EIGHTEEN (18) ON OR BEFORE DECEMBER 1, 2008. SPONSOR: Teacake Bake Shop, LLC 5615 Bay St. Emeryville, CA 94608

TO ENTER:
1. Create a Gingerbread House. All decorations used on the Gingerbread House must be edible. Dimensions cannot exceed 12" x 12" x 12". Base must not be larger than 18”x18” and house must be free standing on the base. The Gingerbread House must: (I) be original; (II) be solely created by entrant; (III) not have been submitted in other contests or won previous awards; and (IV) not infringe the rights of any third party.
2. ALL ENTRIES MUST BE SUBMITTED ONLINE VIA EMAIL. Beginning 12:01 AM Pacific Time (PST) December 1, 2008 through 11:59 PM Pacific Time (PST) December 7, 2008 (the "Entry Period"), submit a photo of your original gingerbread house design to Cortemadera@teacakebakeshop.com. Photo must be in JPEG format and be no larger than 800x600 pixels. The better quality the picture, the easier it will be to judge.
3. PLEASE DO NOT MAIL OR DELIVER YOUR GINGERBREAD HOUSE OR GINGERBREAD HOUSE ENTRIES DIRECTLY TO TEACAKE BAKE SHOP. THEY WILL NOT BE ACCEPTED.
4. Only one (1) Gingerbread House (“Entry”) is accepted per contestant. All Entries must be submitted in English. No Entries will be accepted via facsimile, standard mail, or any method other than the email submission detailed above. No responsibility can be assumed for Entries that cannot be processed due to phone network, electronic or computer hardware or software failure, or technical failures of any kind, regardless of whether the problem arises with Teacake Bake Shop or with the individual attempting to submit the Entry. Teacake Bake Shop reserves the right to modify, suspend, or terminate the contest if the entry, voting, or any other process becomes infected by a computer virus or is otherwise technically impaired. Once submitted, Entries become the property of Teacake Bake Shop and cannot be acknowledged or returned. If there is any confusion or dispute over who submitted a particular Entry, the Entry will be attributed to the holder of the email account used to submit the Entry.
5. All Entries will be reviewed and approved by Teacake Bake Shop. Teacake Bake Shop reserves the right to discard any inappropriate or incomplete entries.
6. The First place Entry will need to be physically delivered to Teacake Bake Shop’s retail location at the winner’s cost and time. The First place entry cannot be mailed in. Teacake Bake Shop will not be responsible for transportation or any costs related to transporting the winning Entry into its Corte Madera retail store. The first place Entry will need to be delivered to the Corte Madera retail store no later than December 10, 2008 and will be showcased through December 31, 2008.
7. All entries remain the property of Teacake Bake Shop and will not be returned.
8. First, second, and third place winners will be contacted before 11:59PM Pacific Time (PST) December 9, 2008 via email or phone.
9. Entries received will be judged equally on appearance, creativity and use of decorations and will be judged by a panel of qualified Teacake Bake Shop judges.
10. Teacake Bake Shop reserves the right to list any Entries on their website at www.teacakebakeshop.com or in any of its retail stores.

PRIZES:
1) First place winner will receive a $50 Teacake Bake Shop gift card.
2) Second place winner will receive a $25 Teacake Bake Shop gift card.
3) Third Place winner will receive a $10 Teacake Bake Shop gift card.
*Gift card redeemable at any of our retail store locations. Not redeemable online.

OTHER:
• All federal, state and local laws apply. Void where prohibited by law.
• All taxes are the sole responsibility of the Winners.
• Teacake Bake Shop is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize.
• Contest rules are subject to change without notice.
• Employees (and members of their household or immediate family, i.e., parents, children, spouse, or siblings) of Teacake Bake Shop are not eligible to participate.
• All applicable federal, state, provincial and local laws and regulations apply. By entering this contest, entrants agree: (i) to be bound by the Official Rules; (ii) that the decisions of the judges are final and binding; (iii) to the use of their names and photographs of their Gingerbread House by Teacake Bake Shop, LLC. for any purposes in all media worldwide without further compensation; (iv) to release Teacake Bake Shop, LLC. and their agents from any and all claims of liability, loss or damage in connection with their participation in this contest or the acceptance or use/mis-use of any prize awarded; and (v) to irrevocably assign and transfer to Teacake Bake Shop, LLC. all rights of ownership in the Entries submitted, including but not limited to, the right to edit, adapt, copyright, publish and use any or all of Entries for any purpose without compensation.
